The introduction of The Town and Country Planning (General Permitted Development) (England) 2015 set out classes of building development for which planning permission is automatically given (providing there were no restrictive conditions). In short, owners of buildings without planning restrictions can change the occupation of their properties without having to go through the lengthy (and costly) process of applying for planning permission.

These regulations originally covered the retail (Class A1) and professional services sector (Class A2), but new regulations came into force on the 1st August 2020 which covers the change of use from an office (Class B1) to residential (Class C3).

The introduction is a timely one – with the Coronavirus pandemic heightening the strengths of a ‘virtual’ workplace, many businesses have been reconsidering their leases. 

With housing (especially in town/city centres) being in short supply, the prospect of converting commercial properties into residential units offers building owners a viable alternative.

Class B1 can be defined:

  • Offices, other than those that fall within Class A2; financial services, banks and building societies, professional services (other than health and medical services) and including estate and employment agencies.

Buildings in Class B1 (as well as A2, for that matter) can be converted into a Class C3 under the regulations – which comprises of:

  • Class C3: Dwelling houses – a single household, or up to six residents, living together where care is provided, or up to six residents where care is not provided.
